Terms of use

These terms govern the conditions for access and use of the platform "APISENSE." and its content. To access to this platform and use it you must comply with these terms and conditions without restriction.

1. Definitions

Inria: means the National Institute for Research in Computer Science and Control. Inria is a public scientific and technological body established in 1967.It conducts research in the sciences and technologies of information and communication.

"APISENSE" Platform: means the infrastructure designed, developed and used by Inria and Lille 1 University available online via Internet.

"APISENSE.bee" Application: means the mobile application designed, developed and used by Inria and Lille 1 University which is downloaded on “APISENSE” Platform by the Participants

Software: means any computer program protected by copyright law and its specifications and related documentation.

"Mobile(s) Terminal(s)": means a portable device for processing and exchange of data. For the purposes hereof the term portable device mean mobile phones and touchpads

Data Collection Software: means the Software for collecting data from Mobiles Terminals of ”APISENSE.bee" Application user who agreed to participate to your Scientific Experiment.

Scientifics Experiments: means the analysis and processing of significant datasets (location, consumption ...), issued from the Participants mobile terminals.

Participants: means the users of the «APIsense.bee" Application who agreed to participate in your Scientific(s) Experiment(s).

Scientific Community: refers to all scientists with access rights to use "APISENSE” Platform for publication of Scientific Experiments on it.

Content: means all documents, information, Software available and accessible from ”APISENSE." Platform. It includes the Data Collection Software.

Collected Data: means data (location, consumption ...) issued from Participants mobile terminals

Personal and/or individual Data: means your personal data collected by Inria and necessary for the creation and management of your account to access to "APISENSE." Platform

2. Intellectual Property

These terms and conditions apply to the use of the website available at www .APISENSE.io all over the world (hereinafter referred to as "APISENSE” Platform). "APISENSE" Platform is the ownership of Inria and Lille 1 University. When using this platform, you accept the present terms of use and Inria grants you a personal, non-exclusive, and non-transferable right to use “APISENSE” Platform. If you do not agree, you are requested not to use "APISENSE" Platform and its Contents.

If you agree on behalf of an organization or other entity, you certify that you have the authority to bind such entity to these terms and conditions, in which case the terms "you" or "your" shall be refer to this entity. If you do not have such authority, you should not get involved and you are requested not to use "APISENSE" Platform and its Contents.

All codes and Software, texts, images, interfaces, photographs, sounds, marks, (referred to as "Content" ) contained on "APISENSE" Platform belong to Inria and Lille 1 University or are licensed to Inria and are protected by French and international laws.

Any Content of”APISENSE" Platform may not be reproduced, downloaded or distributed in any way whatsoever without the prior written consent of Inria.

You agree to these terms and any other conditions of use of Content consisting of Software which you may access from”APISENSE" Platform. The particular conditions of use of these Contents will be specified before each use and will have to be approved by a click on the words "I agree" to have access to such Software. Inria reserves the right to modify these specific conditions of use and particularly encourage you to carefully read them before acceptance.

3. Purpose

"APISENSE" Platform is a research website. It is intended solely for the Scientific Community.

It allows you to publish your Scientific Experiments and access to the Data Collection Software to obtain, in an anonymous form, data from your Participants.

You can only have access to Collected Data from your Participants.

4. Accounts, Passwords and Security

Use of ”APISENSE" Platform requires an access authorization.

To obtain it, you must fill out an online form on the Platform indicating your full name, your business contact email and chose an username and a password strictly personal and confidential.

When validating form, you agree to these terms of use.

Once registered, you will receive email notification of your account creation with a link to the Platform allowing you to activate your account. For your scientific experiments to be published on the Platform you must provide a detail description of Scientific Experiment you want to achieve.

Inria could refuse you access to”APISENSE" Platform without giving any reasons.

You are solely responsible for maintaining the confidentiality of your account and password. You agree to notify immediately Inria by email at the following address contact@apisense.io unauthorized use of your account and/or password or any other breach of security and confidentiality. You may be liable for damages suffered by Inria or any third party due to the use of information related to your account on ”APISENSE" Platform by another person.

5. Data Collection Software

Hereby, Inria grants you a non-exclusive, worldwide, royalty free license to use the Data Collection Software for the sole purpose of achieving your Science Experiments. These exclude any use for commercial purposes, whether to provide services to third parties, or sell any commercial product, unless otherwise agreed in writing by Inria.

You are authorised to download, install, and run the Data Collection Software on a server.

You are not allowed to lease, sell, sublease, distribute, assign, transfer, license, sublicense or otherwise share the Data Collection software or any Inria and Lille 1 University rights on the Data Collection Software.

You can use the Data Collection Software exclusively in its executable version. Under no circumstances, the present terms can be considered as giving you a right to access to source code of this software and a right to use it.

You acknowledge that the current state of scientific and technical knowledge do not permit to test and check all uses of the Data Collection Software, or to detect the presence of possible defects. You acknowledge that the Data Collection Software is available for advanced users and involve risks. You are responsible for control by any means of the Data Collection Software's suitability for your needs; control its operation, its use in conditions that do not cause damage to the Participants and their Mobile Terminal.

The Data Collection Software is provided on a "as is" basis, without warranty, either express or implied, other than the existence of the Data Collection Software, including all disclaimer of warranty relating to a title or deed (of property or exploitation) the lack of infringement, the merchantability, the secure character, innovative or accurate features of the Data Collection Software, the lack of mistakes, the compatibility with your equipment and / or server configuration.

Inria cannot be held responsible for any direct or indirect damages resulting from the use or performance of this Data Collection Software. You agree that any action brought against you by a third party constitutes indirect damages and it cannot open right to you to obtain compensation by Inria.

Upon termination of your account to access "APISENSE" Platform, you agree not to use anymore and to destroy the Data Collection Software and any copies you might have done.

6. Platform and Content

All the Softwares available on "APISENSE" Platform are downloadable in executable form only for the purpose of Scientific Experiments. If you’d like to get a license to use (with or without access to source code) one of the Software for other purposes, please contact us at the following email address: contact@apisense.io .

You are allowed to publish only your Scientific Experiments on "APISENSE" Platform. You may not distribute any other information of any kind.

You're not allowed to use computer programs or other manual or automatic device for (i) acquire or copy all or part of the “APISENSE” Platform and its Contents, (ii) impair the functioning of the “APISENSE” Platform, and / or (iii) violate authentication measures and partitioning implemented on the Platform.

7. Disclaimer of Warranty – Liability

Inria does not guarantee "APISENSE" Platform and its Contents are free of mistakes, defects or viruses on whatever form or that they are accessible permanently. "APISENSE" Platform and its Contents are provided on a “as is” basis and subject to availability. You agree to use "APISENSE" Platform and its Contents at your own risk. Inria reserves the right to modify, suspend or block access to all or part of "APISENSE" Platform and / or its Content for any reason whatsoever.

Inria rejects any form of guarantee for "APISENSE" Platform and its contents. Inria disclaims any liability with regard to the use of "APISENSE" Platform and its contents. Inria shall in no event be liable for any loss or damage due to a failure, mistake, interruption, computer virus, destruction, unauthorized access to ”APISENSE" Platform.

You are fully responsible of the way you use “APISENSE" Platform.

Within the limits imposed by the French legislation, Inria shall in no event be liable for any interruption of ”APISENSE" Platform, the occurrence of bugs or dysfunctions as well as indirect damages (loss of brand image, loss or destruction of all or part of your data or files ..) whatever the cause, origin, nature or consequences, induce by reason of anyone access to "APISENSE " Platform and / or inability to access or from use of "APISENSE" Platform.

Inria cannot be held responsible for any action against you by third parties and / or Participants due to the use of ”APISENSE" Platform and / or participation in your Scientific Experiments published on this Platform. You are fully responsible for smooth, management and monitoring of your Scientifics Experiments.

Inria cannot be held responsible for any dysfunction of ”APISENSE" Platform, whatever the cause.

When using ”APISENSE" Platform, you acknowledge all the risks and characteristics of the use of the Internet, in particular, the possible transmission delays, technical dysfunctions and the risk of hacking.

Inria assumes no responsibility for any damage that may be caused to your computer equipment as a result of access to "APISENSE" Platform and/or the use or download of any of its Contents.

In addition, you agree to be fully aware that regarding the state of the art, it is strictly impossible for Inria to ensure no incursion into "APISENSE" Platform and in particular to ensure the absence of destruction and/or modification or alteration like misuse by another user or any third party of your Scientifics Experiments and/or corresponding files by viruses, worms or other code or instruction affecting "APISENSE" Platform.

8. Infringement of the conditions of use

Any breach of the present terms of use will lead to termination, at the sole discretion of Inria and without notice, of your account and your access rights to the ”APISENSE" Platform without compensation and without prejudice to any damages for which you may claim.

9. Personal Data

In accordance with the law n ° 78-17 of 6 January 1978, the processing of your Personal Data is subject to a declaration to the National Commission for Informatics and Liberties (NCIL). You have a right to access, modify, rectify and delete your data. For that you have to apply by writing to the following email address: contact@apisense.io .

The personal informations collected are kept in accordance with rules prescribed by the law "Informatique et libertés". Your Personal Data are never released outside. They will only be used by Inria to create and manage your user account on “APISENSE” Platform.

Preservation and archiving
The computer registers stored in the system in accordance with the rules regarding security will be considered proof of communications of email, mail registration form, Download Content, Content publications. The filing of registration forms is carried out on a nature to ensure reliable and durable character required by the legal provisions in force. It is agreed that in case of discrepancy between Inria computerized registers and documents in paper or electronic format you will have, Inria computerized registers shall prevail.

10. Collected Data

Participants Data are accessible only in anonymous form. You may not, in any case, know the identity of your Participants.

You have the right to disclose and / or make scientific publication on results providing from the processing of these Data.

You cannot retrieve any personally identifiable information such as names, numbers, private data (account and password) from other applications, and so on and / or provide Scientifics Experiments which could allow recovery of such kinds of information from Mobile Terminal of your Participants (eg, names and phone number of the register...). Such Experiments shall not be published on “APISENSE” Platform.

You agree not to sell and / or commercialize the results providing from the processing of the Collected Data.

Once one of your Science Experiments is complete, you must destroy from your server, without retaining any copies, all Collected Data for this Experiment.

11. Applicable law - dispute

The present terms of use are governed by French law.

In case of difficulty in the interpretation, execution and / or the validity of these terms, Inria and you will strive to resolve the dispute amicably within a period of two (2) months after its appearance. In case the disagreement persists, the matter shall be referred to the competent courts of Lille.

These terms of use may be modified at any time by Inria, in particular in case of technical, legal or jurisprudential changes or due to the introduction of new services. You should periodically check these Terms of Use and you agree to immediately discontinue all use of ”APISENSE" Platform in case of disapproval of them as you are required to accept these terms of Use.
